Delhi High Court Refuses Anticipatory Bail to Woman in Child Trafficking Case

The Delhi High Court has declined to grant anticipatory bail to a woman accused of involvement in a child trafficking case, observing that the allegations were serious in nature and required thorough investigation.

The court noted that offences related to trafficking and exploitation of minors are grave and have far-reaching social consequences. It emphasised that, at this stage, custodial interrogation may be necessary to uncover the larger network, if any, and to determine the circumstances under which the child was allegedly trafficked.

According to the prosecution, the accused was linked to activities involving the illegal movement and placement of a minor. Investigating authorities argued that granting anticipatory bail could hamper the probe, particularly in identifying other individuals connected to the case and verifying documentary and transactional evidence.

The defence sought protection from arrest, contending that the woman had been falsely implicated and was willing to cooperate with the investigation. However, the court held that the seriousness of the accusations and the need for an unhindered inquiry outweighed the request for pre-arrest relief.

The High Court reiterated that anticipatory bail is an extraordinary remedy meant to be granted only when the court is satisfied that the applicant has been unjustly accused or when arrest would be unnecessary. In cases involving vulnerable victims, courts must adopt a cautious approach.

The matter pertains to an investigation being conducted in Delhi, where authorities continue to examine evidence and trace possible links to organised trafficking channels. Further legal proceedings will follow based on the findings of the ongoing probe.
